IMWCA Policy Concerning Extending Workman's Compensation Insurance Coverage to VFD Display Fireworks Shooters
[1 A LEAD Shooter who is a PGI Certified Display Operator should be in charge of every shoot.
IF your department does NOT yet have a PGI Certified Operator for the display – your Lead Shooter should have at least completed the PGI Class, taken the test, fulfilled the academic requirements of the PGI Certification Process and be working toward becoming a PGI Certified Display Operator.
[2 The LEAD and/or Co-Lead Shooter MUST be present and in charge at all times but most especially during the Firing of the Display.
The Lead Shooter is the person in charge of the display from planning, setup, discharge and cleanup. The Co-Lead Shooter (if there is one) is the person who shares equally in the responsibilities of the Lead Shooter.
(It is recommended that a Co-Lead Shooter work with the Lead Shooter on each show to provide backup for the Lead Shooter)
[3 ALL other Shoot Site Workers should have taken the PGI Display Operator Class, Attended the Demos given during that class, Taken & Passed the test.
Display workers need not necessarily be PGI Certified – but this is highly recommended. Display workers MUST each be a Minimum of 18 years of age per NFPA 1123.
[4 A Certificate of Class Completion will be issued to each Person Successfully completing the Classroom, Demonstration and Testing.
A COPY of Class Completion needs to be kept on file with the City in case of a claim. (NOTE: THE CLASS COMPLETION CERTIFICATE IS NOT PGI CERTIFICATION).
[5 A COPY of the LEAD Shooter’s Display Operator Certification Card – once obtained – needs to be kept on file with the City in case of a claim.
Proof of PGI Certification and/or PGI Class Attendance will be requested by anyone filing a Fireworks Show Related Claim.
[6 As PGI Certification is a PROCESS (not just simply a class and test), the IMWCA may opt to provide coverage to those who have successfully completed the Classroom/Demonstration/Testing portions of the process while they gain the REQUIRED 5 “Experience Shows” per PGI Guidelines.
The particulars of any and all claims will be taken into consideration when a claim is filed. Depending upon the particulars surrounding a claim and with weight given to the level of adherence to these requirements, the IMWCA may either Allow or Disallow any claim filed under WC.
[7 EACH Department should have no fewer than one and preferably two or more PGI Certified Display Operators as soon as possible so there will be a ‘backup’ LEAD Shooter available in case of illness, other conflict, etc preventing the regular LEAD from performing the show.
It is suggested that each year, the PGI Certified LEAD Shooter have a different CO-LEAD Shooter work with him/her so others on the crew are constantly working towards fulfilling their PGI Certification requirements so there is a natural succession process ongoing.
It is required that any person applying for PGI Display Operator Certification has been either a Lead or a Co-Lead Shooter on at least ONE - 1.3G (Class B) Professional Fireworks Shoot – AND – they must have worked on a minimum of 4 more shoots in any capacity (a total of 5).
[8 It is understood that not all departments will have a qualified LEAD Shooter right out of the classroom portion of the PGI Certification Process and that until he/she gains enough experience shows to apply for their PGI Display Operator Certification, there may be shows which do NOT have a PGI Certified Display Operator in charge of the show – but that in NO CASE should a person who has not at least successfully completed the CLASSROOM/DEMONSTRATION/TESTING portions of the PGI Certification process simply presume to be covered by Workman’s Compensation Insurance.
No person is PGI Certified without having completed ALL Classroom and Shoot Experience requirements, APPLIED FOR and RECEIVED His/Her PGI Display Operator Certification.
[9 The IMWCA MAY DENY any claim by any person shooting any show by any IMWCA Member Municipality if ANY of these conditions are not met and the decision to allow or deny any and all claims is depending upon the particular circumstances surrounding any claim(s) made.
[10 Until a person has successfully completed ALL REQUIREMENTS set by the PGI and has APPLIED FOR and BEEN ISSUED Certification Credentials by the PGI, they will NOT be considered as and should not be referred to as a PGI CERTIFIED DISPLAY OPERATOR.
NOTE: The PGI keeps record of all Certified Display Operators and works with the IMWCA to assure that any such statement made in relation to a claim is true.
